Why is Obama allowed to conduct a war without the consent of Congress?

There has not been a war declared since Pearl Harbor day. Congress voted to pay for it and that is all they get to do. Republicans are not at the Supreme Court saying enforce the war powers act because they have more power with the law in force instead of challenging the President and getting it declared unconstitutional.
